Limited Lifetime Warranty
This Limited Lifetime Warranty (“Warranty”) is issued by Ceiling Storage and More Inc., an Arizona corporation, doing business as CeilingSAM (“CeilingSAM,” “Company,” “we,” “our,” or “us”), and applies to CeilingSAM branded overhead storage systems and related components (collectively, the “Product”).
This Warranty is effective as of the date of original retail purchase. By purchasing, installing, or using the Product, the purchaser acknowledges and agrees to be bound by the terms and conditions set forth herein.
ARTICLE I
WARRANTY COVERAGE
Section 1.1 Warranty
Ceiling Storage and More Inc. warrants to the original retail purchaser (“Purchaser”) that the Product shall be free from defects in materials and workmanship under normal residential use for the lifetime of the Product.
Section 1.2 Remedy
If a defect covered by this Warranty is discovered, Ceiling Storage and More Inc. shall, at its sole and exclusive discretion:
a. repair the defective Product or component; or
b. replace the defective Product or component with the same or a comparable product.
Replacement components may be new or reconditioned.
Section 1.3 Excluded Costs
This Warranty is limited solely to the Product and does not include labor, installation, removal, shipping, reinstallation, or any related costs.
ARTICLE II
CONDITIONS OF WARRANTY VALIDITY
Section 2.1 Compliance Requirements
This Warranty shall be valid and enforceable only if:
a. the Product is installed strictly in accordance with CeilingSAM installation instructions;
b. the Product is mounted to structurally sound framing members;
c. the Product is not modified, altered, or improperly repaired;
d. the load placed on the Product does not exceed the rated weight capacity and is evenly distributed;
e. no more than two (2) storage units are installed on the same pair of ceiling framing members; and
f. all fasteners and hardware are inspected and tightened at least annually.
Section 2.2 Effect of Non-Compliance
Failure to comply with these conditions shall render this Warranty void.
ARTICLE III
LOAD CAPACITY AND STRUCTURAL LIMITATIONS
Section 3.1 Risk of Improper Use
Exceeding the rated load capacity, uneven loading, or improper installation may result in product failure, structural damage, serious injury, or death.
Section 3.2 Assumption of Risk and Release
To the fullest extent permitted by law, the Purchaser, installer, and/or dealer assume all risk and release Ceiling Storage and More Inc. from any and all claims, liabilities, damages, or losses arising from:
a. overloading the Product beyond its rated capacity;
b. improper or incorrect installation;
c. structural inadequacy of the mounting surface or framing members; or
d. misuse or use of the Product inconsistent with manufacturer instructions.
ARTICLE IV
EXCLUSIONS FROM COVERAGE
Section 4.1 Excluded Causes of Failure
This Warranty applies solely to defects in materials or workmanship and does not cover:
a. improper or faulty installation;
b. misuse, abuse, negligence, or accidents;
c. overloading beyond rated capacity;
d. modification or alteration of the Product;
e. failure to follow installation or maintenance instructions;
f. corrosion, rust, oxidation, or discoloration;
g. environmental exposure or acts of nature;
h. normal wear and tear;
i. cosmetic damage not affecting structural integrity;
j. damage to stored items or surrounding property;
k. commercial or industrial use beyond intended residential use; or
l. installer workmanship.
Section 4.2 Structural Integrity Disclaimer
Ceiling Storage and More Inc. does not warrant the adequacy or structural integrity of any structure to which the Product is attached.
ARTICLE V
INSTALLATION DISCLAIMER
Ceiling Storage and More Inc. manufactures and supplies products only and does not perform installations. Any installation performed by a dealer, contractor, or third party is independent of CeilingSAM. The Company shall not be liable for installation errors, structural failures, or workmanship.
ARTICLE VI
ORIGINAL PURCHASER REQUIREMENT
This Warranty extends only to the original Purchaser and is non-transferable. Proof of purchase in a form acceptable to CeilingSAM must be provided to obtain warranty service.
ARTICLE VII
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CEILING STORAGE AND MORE INC. SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, LOSS OF USE, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT.
ARTICLE VIII
DISCLAIMER OF IMPLIED WARRANTIES
EXCEPT AS EXPRESSLY PROVIDED HEREIN, NO OTHER WARRANTIES, EXPRESS OR IMPLIED, ARE MADE.
ANY IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE TERM OF THIS WARRANTY.
Some states do not allow limitations on implied warranties or exclusion of damages, so these limitations may not apply to you.
ARTICLE IX
SHIPPING DAMAGE
Ceiling Storage and More Inc. is not responsible for damage incurred during shipping or transit. Claims for shipping damage must be filed directly with the carrier.
ARTICLE X
GOVERNING LAW AND VENUE
This Warranty shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any legal action arising under or relating to this Warranty shall be brought exclusively in a court of competent jurisdiction located in Maricopa County, Arizona.
ARTICLE XI
ENTIRE AGREEMENT
This Warranty constitutes the entire warranty provided by Ceiling Storage and More Inc. and supersedes all prior warranties, representations, or agreements. No dealer, installer, agent, or employee is authorized to modify or extend this Warranty.
This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
